1. Agreement to Terms

Welcome to Agentic Jesus (the "App"), a faith-based AI companion mobile application operated by Agentic Jesus LLC, a Maryland limited liability company ("Company," "we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We may update these Terms from time to time. We will notify you of material changes at least thirty (30) days in advance through the App or by email. Your continued use of the App after such changes take effect constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least sixteen (16) years of age to use the App. If you are between 16 and 18 years of age, you represent that your parent or legal guardian has reviewed and consented to these Terms on your behalf. We do not knowingly collect personal information from children under 16.

3. Account Registration

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You may not share your account with any other person or allow others to access the App through your account. Each account is for a single individual user.

4. Service Description

Agentic Jesus is an AI-powered spiritual companion application that provides personalized faith-based guidance, devotionals, and spiritual growth tools. The App includes the following features, which may vary by subscription tier:

• AI Spiritual Companion: Conversational AI interactions powered by Anthropic's Claude models, providing personalized spiritual guidance based on your faith profile. Includes General Chat, Bible Chat, and Wisdom Library chat silos.
• Bible Chat: Scripture-integrated conversations using the World English Bible (public domain) with Matthew Henry Commentary (public domain) for contextual depth.
• Wisdom Library: Curated Christian content libraries with AI-guided exploration. Up to 12 libraries available depending on subscription tier (6 Plus, 6 Premium).
• Journey System: Multi-day structured spiritual growth programs with daily devotionals, Scripture readings, and guided reflection.
• Prayer Journal: A private space for recording prayers, reflections, and tracking answered prayers.
• My Garden: A visual spiritual growth tracker that reflects your engagement and milestones.
• Church Directory: Location-based search for nearby churches using Google Maps/Places API.
• Voice Interaction: Speech-to-text and text-to-speech capabilities powered by OpenAI for spoken conversations with the AI companion.
• Proactive Check-ins: AI-initiated follow-ups, prayer reminders, and Garden outreach notifications.
• Calendar Verse: AI-selected daily Scripture with deduplication to ensure variety.

5. Subscription Plans and Pricing

5.1 Subscription Tiers

The App offers three subscription tiers:

• Essential (Free): Up to 6 messages per day, access to General Chat, Journey system, Prayer Journal, My Garden, Church Directory, daily devotional reminders, and shareable referral link.
• Plus ($6.99/month or $71.30/year): Up to 20 messages per day, all Essential features plus Bible Chat, Calendar Verse Integration, Matthew Henry Commentary, 6 Plus-tier Wisdom Libraries, enhanced model routing, voice interaction, AI shareable cards, and proactive features (check-ins, prayer follow-ups, Garden outreach).
• Premium ($14.99/month or $152.90/year): Up to 40 messages per day, all Plus features plus 6 Premium-tier Wisdom Libraries, priority model routing (Opus-level for Deep Wisdom topics), premium ambient audio tracks, and advanced Garden features.

Prices may vary slightly by platform and region due to app store pricing tier requirements.

5.2 Auto-Renewal and Cancellation

Paid subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel before the renewal date. You may cancel at any time through the Apple App Store, Google Play Store, or the App settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.

5.3 Free Trials

We may offer free trial periods for paid subscription tiers. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate. We will clearly disclose trial duration and conversion terms before you begin any trial.

5.4 Price Changes

We reserve the right to change subscription pricing. We will provide at least thirty (30) days' notice before any price increase takes effect. Continued use after the price change constitutes acceptance of the new pricing.

5.5 Refund Policy

Refunds for subscriptions purchased through the Apple App Store or Google Play Store are subject to the refund policies of the applicable platform. For subscriptions purchased directly, we will consider refund requests on a case-by-case basis within fourteen (14) days of purchase.

6. AI Content Disclaimers

The App uses artificial intelligence to generate spiritual guidance, devotionals, and conversational responses. You acknowledge and agree to the following:

• Not Professional Advice: AI-generated content is not a substitute for professional counseling, pastoral care, licensed therapy, medical advice, legal advice, or emergency services.
• AI Hallucination Waiver: The AI companion utilizes probabilistic language models that may occasionally hallucinate or generate fabricated, inaccurate, or theologically unverified information. The Company expressly disclaims any and all liability for emotional, psychological, physical, or financial distress resulting from a user acting upon misinterpreted or hallucinated AI-generated guidance.
• Crisis Support: If you are experiencing a mental health crisis, suicidal thoughts, or risk of self-harm, please contact the 988 Suicide and Crisis Lifeline (call or text 988) or emergency services (911) immediately. The App may detect crisis situations and provide resource information, but it is not an emergency service and cannot contact help on your behalf.
• Theological Position: The App provides guidance from an orthodox Christian, non-denominational perspective. AI responses are informed by Scripture (World English Bible) and curated theological resources but may not align with every denominational tradition or theological interpretation.
• Accuracy Limitations: AI-generated content may contain inaccuracies, incomplete information, or responses that do not fully reflect established theological positions. You should verify important spiritual or factual claims with qualified pastoral or professional sources.
• AI Model Limitations: The AI companion is a language model, not a sentient being. It does not have personal faith, emotions, or spiritual experiences. It is a tool designed to support your spiritual growth.

7. User Content

You retain ownership of content you create within the App, including prayer journal entries, journal entries, and conversation inputs ("User Content"). By using the App, you grant the Company a limited, non-exclusive, royalty-free license to process, store, and transmit your User Content solely for the purpose of providing the Services.

Your conversation data is processed through Anthropic's Claude API and OpenAI's API for voice services. These providers process your data pursuant to their respective API data usage policies, which currently state that API data is not used for model training. We will notify you if these policies materially change.

You may export your data at any time through the App settings. Upon request, we will provide your data in a commonly used, machine-readable format within thirty (30) days.

8. Acceptable Use Policy

You agree not to use the App to:

• Attempt to "jailbreak," manipulate, or circumvent the AI's theological guardrails, safety systems, or content filters.
• Generate or solicit content that is hateful, threatening, harassing, defamatory, obscene, or otherwise objectionable.
• Use the App for any commercial purpose, including but not limited to offering paid spiritual guidance services based on the App's AI output.
• Access the App through automated means (bots, scrapers, scripts) or circumvent message limits or subscription tier restrictions.
• Reverse-engineer, decompile, or disassemble any portion of the App, including the AI system prompts, theological frameworks, or Wisdom Library content.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the integrity or performance of the App or its related systems.
• Abuse the crisis detection feature by repeatedly triggering crisis protocols without genuine need.

9. Intellectual Property

The App, including its source code, AI system prompts, theological frameworks, discernment engine, Wisdom Library content architecture, branding elements, and all associated documentation, is the property of Agentic Jesus LLC and is protected by copyright, trademark, and other intellectual property laws.

Scripture content from the World English Bible and Matthew Henry Commentary content are in the public domain and are not subject to our intellectual property claims.

If you provide feedback, suggestions, or ideas regarding the App, you grant the Company a perpetual, irrevocable, non-exclusive, royalty-free license to use, modify, and incorporate such feedback without obligation to you.

10. Third-Party Services

The App integrates with and relies on the following third-party services. We are not responsible for the availability, accuracy, or practices of these services:

• Anthropic, PBC: AI language model (Claude) for conversational features.
• OpenAI: Voice services (Whisper STT, gpt-4o-mini-tts).
• Stripe, Inc.: Payment processing for subscriptions.
• Google Maps/Places API: Church directory location services.
• Supabase / Railway: Database hosting and backend infrastructure.
• Expo / EAS: App build, update, and push notification services.

11. Warranty Disclaimers

THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR THEOLOGICAL SOUNDNESS OF ANY AI-GENERATED CONTENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS MEMBER, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

THE COMPANY'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

13. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its member, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your User Content; or (d) your reliance on AI-generated content for decisions regarding your spiritual, emotional, financial, medical, or legal matters.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of laws principles.

15. Dispute Resolution

15.1 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first contact us at team@agenticjesus.app and attempt to resolve the dispute informally for at least thirty (30) days.

15.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in the State of Maryland. The arbitrator's decision shall be final and binding.

15.3 Class Action Waiver

YOU AND THE COMPANY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

15.4 Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court in Maryland if the claim falls within the court's jurisdiction.

15.5 Opt-Out

You may opt out of the binding arbitration and class action waiver provisions by sending written notice to the Company within thirty (30) days of first accepting these Terms. The notice must include your name, account email, and a clear statement that you wish to opt out of arbitration. 15.6 Arbitration Fees

For claims under $10,000, the Company will reimburse your AAA filing fees and will not seek attorneys' fees unless the arbitrator determines your claim was frivolous or brought for an improper purpose as measured by the standards of Federal Rule of Civil Procedure 11(b).

16. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may terminate your account at any time through the App settings or by contacting us. Upon termination, your right to use the App ceases immediately. We will retain your data for thirty (30) days following termination to allow for account recovery, after which it will be permanently deleted.

Termination does not entitle you to a refund of any pre-paid subscription fees for the current billing period.

17. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, EULA, and any other policies referenced herein, constitute the entire agreement between you and the Company.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• No Waiver: The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent. The Company may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Force Majeure: The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet outages, or AI provider service disruptions.
• Notices: We may provide notices to you through the App, by email, or by posting on our website. You may provide notices to us at the contact information below.
